Judicial review dismissed

Judicial review dismissed

Tuesday, February 13, 2024

The judical review into the Harts Farm public inquiry has been dismissed by the Hon Mr Justice Holgate.

Redrow PLC brought the case because they believed that Planning inspector, Joanne Gilbert, made legal errors in relation to sequential tests for flood risk assessments when determining last summer’s appeal.

The decision means that there will be no re-run of the planning appeal and that this may be the end of Redrow's attempt to develop Harts Farm.

Hertsmere planning officers will examine the judgement in detail as the decision will have a widespread impact on the Borough and beyond.

The first defendant in the challenge was the Department of Levelling Up, Housing and Communities, with Hertsmere Borough Council cited as the second defendant.
